Can I Be Fired for Writing About My Job on a Personal Blog or On Social Media Sites?

Let’s face it, work is not always a joy. Whether it be co-workers, bosses, or clients, it’s easy to get annoyed with the people we have to deal with on a regular basis. With the prevalence of blogging and social networking sites, the questions often arises: Can I get fired for what I say about my job online?

The answer is most likely yes, you can be fired for what you say about your job online. The First Amendment to the United States Constitution protects the “free speech” rights of all citizens. However, those rights are protected against government interference, and not against private corporations or other individuals. So if the First Amendment doesn’t protect us against our bosses, what does?

The general rule is that an employer can fire you for any reason. Of course, there are some exceptions to this rule. For example, whistle blowing about an employer’s illegal activity may be protected under a different set of laws. There may also be more specific laws that a pertinent in your state or found in your employment agreement (or union contracts).

The best thing to do if you have been fired by your employer for something you said online is to speak to an experienced attorney in your area. By consulting with an attorney you will be able to determine if you were unjustly fired and, if so, if there is anything you can do moving forward.
