Is It Legal To Own a Gun?

With all the talk lately about assault weapons and the Second Amendment, gun ownership has become a central issue at the heart of both politics and daily life for many Americans. However, given that gun laws across the United States differ in some regard from state to state, it is possible for a good-intentioned gun enthusiast to run afoul of the law if they are not careful.

Owning a gun is legal, generally speaking. However, the question is not that simple because legality issues depend on what type of gun you own, where you carry it, how you carry it, and other details.

For example, it is legal for anyone (with the exception of certain ex-felons and those with severe mental health issues) to own a hunting rifle. Aside from a BB gun, this is the most unrestricted type of gun. There are more restrictions, however, surrounding the ownership of handguns and semi-automatic rifles.

That point needs further clarification, however. Owning a handgun is legal; carrying it may not be. That is to say, you need a license to carry a handgun. This is called a “concealed carry” permit; it allows a holder to carry a gun concealed on their person. In most states it is illegal to “open carry,” which means to carry a weapon in the open.

Assault rifles are regulated by the type and capacity of the accessories and clips. For example, most assault rifle clips must contain less than a certain number of bullets.
