Is It Legal To Spank Your Child?

Do you spank your children? It may not make you popular at a dinner party, but you likely would not be the only one there to do it. Statistics suggest that a large number of parents are still “old school” when it comes to corporal punishment with their children. Many more parents may occasionally resort to some form of physical reprimands than would ever actually admit.

But is it legal?

The short answer is yes: it is legal for you to use small amount of force to discipline your children, depending on the state you live in. However, it is possible for spanking to cross the line into child abuse.

Each state is different, but they all define some limit where spanking becomes child abuse. Generally, the law considers the following factors when determining is the act in question is “spanking” or “child abuse”:

- the ago of the child
- the amount of force used
- the type, location, and frequency of the force
- the condition of the child

Sometimes, the law can be pretty vague when it comes to the line between spanking and abuse. However, the following acts are routinely held to be abusive:

- using an object other than a hand to discipline a child
- using a closed fist to discipline a child
- burning as discipline
