Client's Injuries In South Florida Police Stop Were No Accident
By David Fuchs
A female client of mine was recently injured and was forced to endure a humiliating and degrading body cavity search by the Coral Springs Police Department.
As she reported to Willard Sheppard of NBC 6, she was lawfully driving her sister's car when she was stopped by Coral Springs Police. This South Florida Police Department has stopped her ten times within the past year. In each of these stops the police failed to give my client any articulable or reasonable reason for the stop. In the most recent stop they claimed to have stopped her for "tints that were too dark".
They grabbed her and pulled her out of the car. They twisted her wrist and shoved it behind her back. She was inexplicably charged with "resisting arrest without violence."
The police realizing that my client was having a severe panic attack, and perhaps that they had stopped and abused an innocent woman, transported her to a local hospital where she received medical treatment for the injuries she had sustained during the stop.
After the conclusion of her exam at the hospital a female officer told my client that they had not yet searched her and commanded her to "turn around and spread her legs." She was then subjected to a humiliating and degrading search of her genitalia. There was no one present in the exam room other than my client and the female officer.
My client, who is African-American. is adamant that this stop and arrest was no accident, but part of a yearlong pattern of harassment by the police. She reports that they have also harassed her young children multiple times on the way to and from their school.
Based on the evidence we have obtained I have to come to the conclusion that this stop and arrest as well as the others were part of a pattern of racial profiling of my client by the City of Coral Springs Police.
My client has the right to seek compensation for violation of her civil rights together with the approximate $1700 hospital bill, and her pain, suffering, humiliation and degradation that she suffered at the hands of the Coral Springs Police.
